1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of Acalink’s mentorship platform. By accessing or using the services, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old and a current or prospective law student or graduate to use Acalink. When you sign up, you represent that the information you provide is accurate, complete, and kept up to date.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized use of your account. Acalink reserves the right to suspend or terminate accounts for violations of these Terms or suspicious activity.
4. Mentor and Mentee Responsibilities
Mentors and mentees are expected to interact respectfully, keep communications professional, and honor scheduled sessions. Content shared during sessions should remain confidential unless both parties agree otherwise or disclosure is required by law.
Mentors participate on the platform as independent contractors. Nothing in these Terms or use of the services creates an employment, agency, or joint venture relationship between mentors and Acalink, and mentors remain solely responsible for their professional conduct, obligations, and any applicable taxes.
To preserve the integrity of the marketplace, mentors agree not to circumvent Acalink by soliciting, accepting, or processing payments or engagements with mentees outside the platform. All mentorship bookings, reschedules, and payments must remain within Acalink. Acalink reserves the right to suspend or terminate accounts that violate this non-circumvention policy and may seek any remedies available under law or equity.
5. Payments and Cancellations
Payment terms, pricing, and cancellation policies are described within the platform. Fees paid are generally non-refundable unless otherwise stated. Acalink may reschedule or cancel sessions if necessary due to platform issues or mentor availability.
6. Prohibited Conduct
You agree not to misuse the platform, including engaging in harassment, sharing false or misleading information, attempting to gain unauthorized access, or interfering with the operation of the services. Acalink may investigate and take appropriate action for violations, including suspension or termination.
7. Intellectual Property
All content, trademarks, and features on the platform are owned by Acalink or our licensors. You may use the services only for their intended purpose and may not copy, modify, or distribute platform materials without prior written consent.
8. Disclaimers
Acalink provides mentorship facilitation services and does not guarantee specific outcomes. The platform is provided on an "as is" basis without warranties of any kind, whether express or implied, including accuracy, reliability, or fitness for a particular purpose.
9. Limitation of Liability
To the fullest extent permitted by law, Acalink shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability for any claim related to the services will not exceed the amount you paid to Acalink in the three months preceding the claim.
10. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in New York County, New York.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.
